Dear ----,
Thank you for the email you recently sent to us.

As a temporary resident, if you apply to extend your stay in Canada as a worker on or before the expiry date of your authorized stay, you will be considered in status until a decision is made on the application. This is known as Implied Status*. While you are under implied status, the conditions imposed on your most recent authorized stay will still apply and will have to be respected.

*For more information on Implied Status, please see the Operational Manual for Overseas Processing (OP 11, section 24).

If you leave Canada while under implied status, you may be authorized to:

• re-enter Canada as a temporary resident, if the Case Processing Centre (CPC) in Vegreville, Alberta, has not yet made a decision on your application to extend your work permit. Please note that you will not be permitted to work until you receive your new permit. You must satisfy the officer at the port of entry that you have sufficient means of support. This applies if you:
    o are temporary resident visa (TRV) exempt;
    o held a valid multiple-entry visa before leaving Canada; or
    o travelled only to the United States and/or St.Pierre and Miquelon;

• re-enter Canada as a worker, if the officer at the port of entry determines that your application to extend your work permit was approved by the CPC while you were outside Canada;

or

• apply for a new work permit at the port of entry provided you have the right to do so under the Regulations.

In order to prove your Implied Status, we recommend that you travel with:
• your expired work permit;
• your receipt of payment for $150;

Furthermore, when you submit an application to request an extension of your temporary resident status to the Case Processing Centre (CPC) inside Canada, a TRV is not automatically issued because you are already inside Canada.

If you plan on leaving Canada and returning during the validity period of your current study permit, and require a visa to re-enter Canada, you must send a TRV application to a Canadian visa office outside of Canada:

• responsible for your country of residence;
• responsible for your country of nationality; or
• in the United States of America.

The application is available on our Web site. You can fill out the application online and print it or print it and fill it out by hand.

In most cases, this document is either:
• a single-entry TRV, which allows individuals to enter Canada only once during the validity of the visa, or
• a multiple-entry TRV, which allows the individual to seek entry into Canada from any country as often as necessary during the validity of the visa.
