【求助】租客突然不租了要求退房租和DEPOSIT
我们在多伦多以外的一个小城市里开个小生意,赚了一点钱今年在大学旁边刚买了个出租房,想租给这里上大学的学生。7月份的时候有个洋人女子给我打电话要给她儿子租房,因为她在外地所以她让她的嫂子来看了一下,很满意,于是马上告诉我让我寄给她合同,她同时给我头一个月的房租和半个月房租的Deposit.从8月1日开始, 我于当天晚上用email把我已经签好字的合同发给了她,三天后我也收到了她寄来的钱MONEY ORDER 头疼的事来了,一个星期后我收到她儿子的电话,让我退钱,原因是他已经租了别的房子,她妈妈给他租房子没跟他商量。我说如果我能找到别人在8月份顶你的合同,我就退你房租。但是我只能找到从9月开始租的学生。于是我在信里告诉他们我不能退你们的房租了,因为我只能找到从9月开始的租客。 她妈妈开始威胁我要让他爸爸来要房租,我没理。 现在又写信告诉我会派别的人到我的店里来要房租,不管我给还是不给。因为我的小生意就在大学旁边,因此很多人都认识我。 一个月的房租并不是什么太大的事,但是我很生气,如果你要钱你应该先认错,不应该咄咄逼人,因此我刚刚给她发信说:既然给你解释了很多遍你也不听,那么咱们最好上法庭吧。反正不论你派谁来我都不会给的,你得为你自己的错误负责而不是我,如果来人影响我的生意我肯定喊警察。 发了以后,心里又有点犯合计,因此请大家给评判评判。 我做的对不对 如果不对,该怎么做 如果派来个人搅我的生意,我真的该喊警察吗 谢谢 |

Marg, Thank you for your reminding no one sign the lease, that is why I keep every email from you, I don't think these emails gonna be useless when they are shown on the court. In honest, I don't care too much one month rent + deposit, but I was so angry from the beginning you and your son try to get the money back directly without any responsibility, try to discuss with me just like making a unfaithful deal. I really should just ask you get somebody instead of your lease, just like what other owner did, not me. That is why I decide to want you learn how to respect somebody and how to be responsible for your own decision, especially how to respect the ACT of Lease. I will keep 175 and return 350 to you, I could hold more but I won't, I could return all but I won't, I think 175 is enough to make you remember how to do next time. if you agree please let me know. 她最后只是想要回deposit
我把房租都退了,惩罚的目的达到了,就适可而止吧 这是我回的她的信 Hello Tim You at least owe me the damage deposit, which would be returned if the apt. is not harmed, which of course, it was not. As I recall that was 175 $. I will send someone tomorrow or the next day. I would appreciate some refund as well, and remind you that no one signed the lease.. Marg |

你必须向银行确认那个money order clear了,或者问要多久clear,然后告诉那个人什么时候才可以退钱。因为一般信用好的账户都会直接将存入的支票/money order/bank draft体现在你的账面,较小金额(取决于你的帐户状况)甚至不会hold,这一点online banking无从体现。 至于退哪部分钱,你的状况下实际上是无所谓的,因为不清楚你们的合同或者口头协议,上法庭你无论如何都可以赢一部分钱。但一般来说可以保留一个月或者到再找到租客的前部分的租金,而退还damage deposite(这部分取决于你们协议名称)。而且他发的是money order,一旦没有注明用途,甚至不用理他都可以(当然很不地道)。 如果确认进账无误,而且已经退了350,告诉他那是那一半是半个月房租,一般是deposite。如果发现order有问题,20块支票charge back. 而后来又没问题了,退款中再减掉20块。 |
