【求助】如果房客赖着不走,你会怎么做?
-------------------------------------------------------------------------------- 案例如下: 由于长期毁约(房客未按时交房租)給了三个月的通知请他们走,理由是“ continuing breach the contract",今年一月底到期,但房客说天气太冷,要求通融到三月再搬走(有email 为证),于是二月底开始登广告找新房客。其中,旧房客又说时间太赶再给一个月时间,于是又把换新房客时间改为4月一号。 现在和新房客签约了,也拿了订金(但还不敢存进银行),旧房客却开始要求要想再住半年(二月房租未付清,三月更不期待会拿到钱),我们不再通融,要求房客签一张字据说三月底会搬走。 房客口头当应会搬走,但却拒绝欠任何字据。 心里担心到时候旧房客不走,新房客没地方住会引起麻烦。想知道大侠们会怎么做?是否需要上法院去拿个court order,以防万一? |

但是有诸多情况下,房东无办法驱逐房客.比如,怀孕,残疾,天冷等等. 所以,房客可以找任何合理的理由拒绝搬出.即使政府发了HEARING的通知,协调等等,等真正搬出去不知道哪年月了.告到法院,更是遥遥无期. 所以, 房东明智的做法是在经济上作出合理必需的让步,协商解决问题. 万不得以不可以激化矛盾. 注意:断水断电,换门换锁,清除客人物品等等,均是违法行为!!! |

通常的做法是通过法庭获得一个possession order, 然后可以强行赶走房客. 如果你在alberta省,告诉你一个比较快捷的办法,比去法庭省时,省钱,省力.Alberta省政府有一个新的服务项目-residential tenancy dispute resolution service,通过这个政府部门也同样可以得到possession order,效力和法庭的order是一样的(属于行政判决).可以参考下面的连接: http://www.servicealberta.ca/rtdrs/ |

没啥硬道理.也没人撵到大街.赶出去之后由社会福利安排.你没必要也没理由替政府出钱养着.homeless那帮子人大冬天的也都有地方呆着.有吃有喝.只不过你要follow这个过程.一步一步走.你当然不能一上来就叫警察.这当然没用.因为不合法.也不是法院判.这个是由ltb来判. What can a landlord do if the tenant does not move out of the unit by the date set out in the eviction order? Orders issued by the Board are legally binding decisions - they must be obeyed. If the tenant is ordered to leave by a specific date and has not, then the landlord can file the eviction order at the Court Enforcement Office, pay the applicable fee, and ask the Sheriff to remove the tenant from the unit. The Sheriff will usually give the tenant a notice that tells them the date they will come to the unit to evict the tenant. If the tenant has not moved out by that date, the Sheriff will go to the unit and remove the tenant from the unit. The locks on the unit can then be changed. Only the Sheriff can evict a tenant who does not leave a unit as directed by an eviction order issued by the Board. |
