Sorry I am in the office right now, No Chinese. 1. My mom was in Canada when the sponsorship was approved. 2. she just arrived in Canada when I submitted the sponsorship application. But this is not necessary. You can submit the sponsorship application if she is not here. 3. If you want to transfer her immigration application to USA after the sporship is approved, she must stay in Canada for at least 1 year when the sponsorship is approved (please double check the sponsorship application guideline. there is one clause about this) 4. I don't think that two-year stay in Canada will count as they have left already before the sponsorship is approved. They'd better stay in Canada 1 year before the sponsorship is approved. Then you can request to submit the immigration application to USA. Here is the process: - sponsorship application (no need in canada) - 1 year stay in Canada waiting for sponsorship approval - request CIC to transfer immigration applicaton to USA 1 month before sponsorship approval -sponsorship approved -sumbit to visa office in USA Also, that 1-year stay will be counted as 0.5 year landing time. max to 1 year. i. e. my mom stayed in Canada for 3 years already, so CIC would regard her landing time ( Yi Min Jian ) as 1 year. LZmm, what does Children’s birth certificates (Item 3 in the Visa Office Specific Instructions of Buffalo) mean? Is that your birth certificate? Will they return the original copy of your submitted documents after they approve your parents immigration application? Thx |

Yes. sponsorship 批下来的时候,老人要在加并且已经1年以上就可以要求把他们的移民申请转到美国了 b. yes, I checked the processing time on CIC website very often. 1 month before that estimated time, I faxed to Mississauga office asking to transfer the immigration application to US. I asked for Baffulo visa office and later Buffalo transferred my case to Detroit which is faster. I am not sure whether you can ask to transfer to Detroit directly (I guess you can). You can call CIC service line to check. Good luck! |

Hello there, Sorry. I guess I cannot help with your case re. your brother's situation. I think it depends on how old your brother is. Maybe if he is under 18, that should be ok. Can you please call CIC service line to check? I don't want to give you wrong info based on my guess. Good luck! |

Sorry I cannot find the link. I know some Chinese seniors that they stayed here at least one year when the sponsorships were approved. And when they got the immigration status and applied for citizenship, that 1 year counted for 0.5 years and max to 1 year. If I find the link, I will post here. |

I just followed the application guideline of Detroit visa office (you can download from CIC website or Mississauga office would send you one copy of application package). The checklist gives you a clear clue of what to sumbit. here is the link of Buffalo's requirement. http://www.cic.gc.ca/english/pdf/kits/guides/E33048.PDF I asked my sister to have all the required notaries done 2 months before the sonsorship approval. I remember somewhere mentioned that the police certificate & clearnance (no crimal record) must be within 6 months before submission. I think it is better to have these notaries done at most 6 months before the sponsorship approval. My understanding is if they submit their immigration application in Canada, they must have their health checkup in Canada too. My mom was asked to have health checkup 1.5 months after application submission. I think if your parents go back to China, they have to come back for the health checkup. If they ask for health checkup in China, their case may be transferred back to China. I heard this from a friend. |

Item 3 refers to any child under 18 years old who will accompany with your parents to immigrate to Canada. If only parents immigrate to Canada, you don't need to look at this item 3. But you do need to provide your birth certifcate notary to Buffalo indicating your DOB and your parents' names. This is for item 5 - proof of relationship in Canada. |

Yes, I have to say that I am lucky. I was surprised too. But the website doesn't have Detroit visa office. That is why I posted my question here. My case was transferred from Baffulo. I am not sure how long it takes in Baffulo. 2 years ago two friends' parents applied in Baffulo and all got their landing paper within 5 months. |

Baffulo office transferred my case to Detroit directly and notified me by mail. When I sent my request to Mississauga asking for transferring the immigration application to Baffulo, I didn't know that Detroit can also process the immigration cases. and I have never heard of anyone who submitted their cases to Detroit. So I assume that Detroit visa office is a new location to process immigration cases. You can check with CIC service line. Good luck! |
