除了Joint Tenancy外,Designated Beneficiary Asset 也不能列入遗嘱的,典型的就是Life Insurance Policy, 如果你指定一beneficiary,你去世后,你的insurance自动归其继承。 其他不能列入遗产的还有RRSPs, Registered Income Funds和private pension plans. 当事人离婚后不幸去世,其原配偶于离婚后2年之内有权向法庭上诉,追溯他/她应得的遗产。 此帖于 Oct 15th, 2006 16:20 被 青青方竹 编辑。 |

需注意的是,the estate 付RRSP/RRIF的税,而不是the designated beneficiary of the RRSP/RRIF付税。 若当事人没有指定受益人,死时也没有遗书,死后这些东西归加拿大的慈善机构所有。 |

Specific gift 又分为Bequest/Legacy和Devise两种。Bequest/Legacy 通常是指a gift of personal property, 包括a gift of cash。而Devise通常指a gift of real property。比如说,你的遗嘱中给你妈妈现金2万,这是Bequest。你的遗嘱中说把你的车子送给你的朋友,这也是Bequest。但你的遗书中提到将你的房子给你儿子,这才就是Devise。 Residue是指付清所有debts和expenses,分完所有Bequests和Devises后,所剩下的所有遗产。 |
