Question 请教自雇(Self-Employment)的CPP和EI等deduction问题

我最近签了一个contract, 没有注册公司, 以个人名义签, 定义每天的rate以及一天工作小时数, 作为consultant, 实际上是为该公司承接的一个软件项目做开发。同时签了一份agreement,无条件免除该公司Revenue Canada对我的CPP, EI或者可能发生的罚款的追讨责任。也就是说,他们只付我一个固定的金额,所有CPP, EI等都我自己交。

我的问题主要是这种做法是否合法,如何维护自己的合法权益。

我看了一篇文章是http://www.interlog.com/~barbara/agency.html, 里面说该公司应该为我出属于雇主那部分CPP和EI, 并且这项规定优先于其它协议。

"However, the agency is not entitled to charge or recover from the consultant any portion of the employer's UI or CPP premiums. This takes precedence over any other agreement. The placement agency must incur the expense of the employer portion of the CPP contributions and UI premiums. The agency cannot recover these from the worker and cannot bind the worker to "opt out" by having the worker sign an agreement contrary to these regulations. "

另一篇文章http://www.calgary-smallbusiness.com/contractor.html, 里面更提到如果被查出将实际被认定为employee作为contractor的行为,公司和我个人都会受到处罚

Penalties
If your company is audited and Canada Revenue Agency rules that your "contract workers" are actually employees, each party will be responsible for a MINIMUM of:

Payer:
1. CPP and EI employer and employee contributions for the current year and the previous year.
2. 10% penalty on the total assessment and interest of approximately prime +1% from the date each of the contributions were due.

Employee:
1. Personal back-taxes, if unpaid.
You may not need to pay EI if your workers are related to the owners of the business even if they are employees. Contact Canada Revenue Agency before ceasing to deduct.

而根据CRA(CCRA)的document "Employee or Self-Employed?" http://www.cra-arc.gc.ca/E/pub/tg/rc4110/rc4110ed.html 中的几个标准, 我应该属于被认定为employee.

固然我明白公司这么做就是为了节省成本,只是我不想涉及不合法不正规的事情,如果有可能维护自己的权益则更好。

这个题目值得深入探讨. 最近我有个朋友找到了个CONTRACT工作, 也有类似的情况, 雇主推卸了一切责任. 看来该讨论如何有效的维护权益了, 即尽量试图用法律推翻不合理的协议. 请大家看看有没有什么好方法.
