【求助】叔叔阿姨请帮忙!!!!!!!!!!!!!!!
叔叔阿姨请帮忙. 处于这种情况的我不知道该怎么办 我今年16岁。 2009年8月28日 我跟我两个朋友去downtown逛街 进了H&M 我是很爱逛街,很爱试穿东西,但也不一定买 我跟我朋友们就在那边试穿发夹,帽子,首饰之类的 试了很久很久 突然换话题说等下要干嘛, 我们决定去旁边的那家咖啡店坐一坐, 然后就回家. 我们出H&M的门不久,有一个外国的中年男人把我们叫住. 问我要我头上一个蝴蝶发卡的收据. 刚开始我不知道他在说什么. 后来我摸头发,摸到了那个发卡, 是我粗心大意戴在头上,忘了放回去叻. 后来又有一个东南亚的男人从店里出来, 他们两个人把我们领到了一个小房间里面. 我跟我朋友们坐在那里面,过了一会他们人都进来,又来了一个女的, 关起了门。 那个外国男子要我们把包都拿出来,他一一翻开,把东西一一都拿出来了。 还在问我们有没有拿别的东西。 我们包里什么也没有,就只有相机跟钱包。 我跟他们解释,我真的不知道那个发夹在我头上卡着,如果我知道我一定会放下来。我朋友也是这样说。 那个外国男子说"I caught you on camera" 他们不听我的解释. 我们就坐在那边。但是真的很害怕,怕被冤枉还有怕惹麻烦给家长们因为真的没有要拿要偷的意思, 我们都在那边发抖,很不舒服. 整个过程大概2,3个小时。 在小房间里面有我,我两个朋友,有一个女的,还有那个东亚男子. 那个外国男子整理了一下就出去了。 那个东亚男子在跟那个女的聊天,他说如果他看到我头上戴发夹了,他一定会上来拦住我。 后来他们在聊一些他们的事情。 再后来我一个朋友的妈妈来把她带走了。 之后就剩我根我另一个朋友。 电话响了,是那个外国男子的电话. 我跟我朋友在旁边听不到什么,后来挂电话以后那个女的跟那个东亚男子笑着说, 那个外国男子要求她把我们弄哭,然后奖励她10块钱. 那个房间里有监视器,所以可能会看到。 这是我跟我朋友的猜测,具体我们不知道. 后来我另一个朋友的妈妈也来把她接走了. 最后来的是我妈妈, 因为家住得比较远。 我来了以后他们让我妈妈签字,说会有一个罚单寄到我们家,如果我们不想付可以上法院。 现在这个罚单寄到了, 我们不知道该怎么做。 当初那个发夹好像是5块钱,现在他们的律师罚我们500多。 说交钱就没事了,也不会有犯罪记录或者跟警察有关系的东西。 付了这钱我就是被冤枉死了. 不付这钱我怕后来期限到了再付就会翻好几倍,而且信上有写说如果要去法庭什么的, H&M那方会把请律师, 什么之类的费用都算在那个罚金里面, 如果我们输了那就会增加好多好多。 我不知道该怎么办,不能被冤枉。 妈妈宁愿有个上庭的机会为我辩解,但是不知道会不会对我造成信用,或者犯罪记录的影响如果输的话。 |

事实所发生的时候我妈妈都不在现场, 都是我们3个小孩子。 他们要我们联系家长的时候,我妈妈明确说他不来,说要把我送警察局。 但是他们说,他们认为这不是个好办法。 妈妈后来想想说如果要叫警察我会被带去哪他都不知道,所以妈妈还是赶过来了。 当时我在那边都呆了很久了,妈妈来了就想说赶快处理完把我带回去。 他们说签完字就可以带我走了。 妈妈签字,然后我们就走了 |

叔叔阿姨们,信上是这么说的 Dear 妈妈的名字 Re: Hennes & Mauritz and 我的名字 Recovery of Civil Damages/Our Case Number I am external legal counsel for H&M (the "Retailer") with respect to civil recovery matter. It is alleged that on August 28,2009, a young person under your care and suctody, (namely 我的名字) took unlawful possession of merchandise from the Retailer's premises located at 那间H&M的地址. The retailer takes the position that it has the right to claim damages from the said young peroson and/or you as a result of such action based on theft, damages and conversion. The Retailer's right of civil recovery and payments made to the Retailer are separate and distinct from any criminal proceedings which may be instituted by the police. The Retailer also takes the position that it has the right to claim damages from you as parent or guardian of the young person for failing to provide reasonable supervision of the young person. You have a right to be represented by a lawyer with respect of this claim. The Retailer is prepared to settle its claim for damages in return for a payment of $504.95 (the "Settlement Amount"), received on or before Novemeber 29, 2009. If this amount is not paid, i may receive specific instructions, whether or not to arrange for a law firm in your jurisdiction to commence legal proceedings before a civil court for all damages, plus interest, legal expenses, and other administrative costs incurred by the Retailer in connection with his matter. These latter amounts may increase if payment is not made by the noted date. This settlement amount is based on the costs associated with the detection, apprehension, recovery of goods and damages associated with shoplifting, hereafter referred to as Recovery Costs. Retailers have calculated the average Recovery Costs to be approximately $900.00. The settlement amount is significantly lower than the Recovery Costs, however, should the retailer be compelled to prove costs in Court, they would rely on the higher or actual mount of Recovery Costs in any civil claim field. Should you choose the settle the Retailer's claim by payment of Settlement Amount, pay ment should be made by cheque or money order, made payable to "CIVIL RECOVERY" on behalf of the Retailer, with your name and the above case number noted thereon. The payment should be sent in the enclosed postage paid envelope or to the following address. I have been advised that Canadian retailers estimate shoplifting amounts to an annual expense exceeding $4.0 billion. Experience indicated that pursuing shoplifters for such losses reduces the number of shoplifting incidents, resulting in savings which can then be passed on the consumers. The hudson's Bay v. wWhite supports the position that shoplifters, in certain cases, are liable for punitive damages. 妈妈咨询过律师了
首先谢谢各位。也谢谢妈妈对我的信任。妈妈今天咨询了律师,我们会这样做: 1,我会写一封道歉信给律师,同时也会CC我的老师或校长。 2,我将阐明我没有偷东西的企图和当时的情形,尽管是由于我的疏忽造成的这种局面,我还是有错的。--- 给所有involved的人和家长带来不便。。为此我将在用我的业余时间到社区作10小时的volunteer。 3,同时我会让社区给我出据我以前的volunteer记录。 所有这些我都会寄到律师那里同时copy我的老师。--- 我的老师信任我。 如果这样他们还要上厅,就由他们了。 再次感谢大家。 |
