默认 商场房东违约允许开设第二家按摩店

大家好,

这几天碰到这么个事儿。 我5年前在一个小型的华人商场里租了一700sqft的店铺。当时商场的主人口头答应不会再此商场内出现第二家按摩店。但1年前,商场转让,新的房东在1个月前和另一家按摩店签了租约,他们现在已经开张了。这个小商场里一共才不到10家的生意。那么现在肯定会影响到我的生意。我现在有什么办法能让房东履行前房东的诺言呢?能打官司吗?我该怎么办?

我在蒙特利尔,以前有个朋友想在家附近开个店,同一个owner的小mall里有一家有20%经营业务重复的店不同意,结果作罢!

口头不算。别说新房东没答应过你什么,就是旧房东不承认当初说过的话你也没辙。去法庭凡是没写在纸上的都无效。你现在希望新的生意支撑不了多久。一旦做不下去了,你赶紧跟房东说补一个独家经营的协议(书面的!)。

老外的房东不会这么干的,不允许自相残杀,犹太人精得很,多数都是尽量开不同的生意。
