默认 和前房屋管理公司的纠纷

买了房子就搬了,在前天30号由于U-Haul的失误我们没有拿到truck,还浪费了一个上午的时间,下午我只能用我的suv一车一车的往新房子运,运了大概几十次,完了大概是凌晨3点多了,离开时我匆匆看了一下没有遗漏就离开了,忘了锁阳台门。回家睡了一会就上班,中午我去交钥匙,物业管理告诉我有猫在单位里的客厅拉尿了,还不止一处,有新有旧。我说我没有养宠物,新的可能昨晚别家的猫进来拉的,旧的应该是旧房客的猫留下的。她说无论如何猫尿不能洗了,要换新的,700元的deposit不能给了,可能还要加钱,地毯很贵云云(大概20*12尺的面积)。我觉得不公平,首先这个地毯本来就有点旧了,5年以上,一般地毯也就5年需要换一次了,她说不是,地毯有30年的寿命。还有猫尿可以洗的,我问个两个清洁公司都说猫尿狗尿没问题,新的可以洗一面就够了,严重的,已经渗到下面的要洗两面(洗两面这个面积的地毯65元),最严重是换掉那部分的underlayer,under layer很便宜,几毛一尺。我告诉她这个,她说stupid,谁都知道猫尿在地毯不能洗。我说那好吧你叫你的清洁公司看看到底有多严重要换新的,写个报告大家看看能不能洗,洗要多少钱,换要多少钱。她说好。今天我又去看了,谁知道她几经将地毯,连同底垫,还有钩地毯的排钉全部扒出来防到门口了。我问你叫清洁公司看了吗,她说没有,如果叫会比换地毯本身贵很多。如果要叫,你叫你自己的清洁公司看,不过这些东西很快要扔掉了,你要立即叫,不然让他们去垃圾场看(现在正是清洁公司最忙的时候,不可能随叫随到的)。
700元不是什么大数目,只是生气她先斩后奏的手法。想问问这样该怎么处理,如果投诉他们能不能胜。

在法律上讲,你只需把地毯回复到原样。就是说洗干净就可以了。即使需要换,他原来的地毯也需要折旧啊。让他到小额法庭去告好了,不会超出那个钱

问题是在确定地毯能不能恢复原样之前她把地毯都拉出来了啊,她说猫尿难闻,不拉受不了,可她自己家就养了两个猫的。

关于房子的状况还有些细节。
- 新主客是他们物业公司的打杂,在住一个同一个物业单位的,物业公司安排他在我们搬出后住我们的单位。他跟我说他那边没有搬出的期限,所以来不及清洁迟一两天没关系,管理也这么说的,她不会charge late moving 的钱。不过我们在31号凌晨搬好了,不过没有清洁。
- 搬走前几天我预计自己没有时间清洁了,我跟这管理平时的关系不错,就问她有没有好的cleaning lady帮我们清洁,她说我帮你清,收15一个小时,我说好但是你要到我们单位看看给个quote到底要几个小时(旁边中国学生住过的单位比我们的差好多,临走前还爆水管,请人倒垃圾清洁全包120,我想你要收也大概这个数),还有清洁到让你们boss满意的程度的,她说好,you don't need to worry anything, just move,但她要收cash。
- 我们搬那天没看,说要等我们搬好才好看。后来我们搬好住新房子了,我在上班时打电话给我说要20小时,说我知道你们中国人的做饭方式了,厨房everywhere is greasy。我想一个上年纪的阿姨爬上爬下清洁不容易,就同意给她300了。但我说明不同意换地毯,她说了一些威胁要上court的话。
- 昨天lunch hour我去看,她还在搞,看见我很不友善,拉着我到处看活有多脏多累,把擦布递给我让我自己试试,我有点生气,说我付你300就是要清洁的,我自己有时间做请你干什么。她说OK you don't have time就转身干活了,有点翻脸的感觉了。我就走了,她就提醒我如果要检查门口的地毯要明天中午之前,否则地毯就要拉去垃圾场了。我回去打电话给几个地毯清洁公司,他们很忙,最早下个星期才有人。

不知道lz在哪里,我们上月底也刚搬完家,感觉super和管理公司都还不错。提前一个月super就来检查了一遍,指出炉头冰箱浴缸要我们清洁,他们要做的是换厨房台面、刷墙、洗地毯。管理公司也给我们寄了一封信,说明如果没清洁的话要charge我们清洁费90刀(1房1厅)。

我们搬完家后又折回去打扫卫生,就是清除垃圾,吸一遍尘,冰箱炉头浴缸之前已经重点清洁过了。打扫完后找super,结果super出去了,我们提出把钥匙扔进office,super不同意,坚称要我们在场才能做inspection。害得我们第二天又跑一趟,还担心他挑剔卫生做得不好,不过还好,super看了一遍就pass了。

我们跟你的情况不同啊,我们新房子铺好地板之前不能搬东西,所以拖得很后,如果有时间我们也会清洁到好的。我付300给她清洁就是因为我们实在没空,想搬了东西就走。现在她干着干着说20个小时不够要40个小时,那是600了,我实在忍无可忍让她停止不要干了,我自己找人清洁。
有时想付几百元息事宁人,看看她又要请律师又要上法庭明显欺负人的样子,就不想他们这么舒服拿我的deposit.

Scheduling the condition inspection

The landlord must offer a tenant an opportunity to schedule the condition inspection by proposing one or more dates or times. If none of the times are suitable, the tenant can suggest alternate times to the landlord. If the times are not suitable, the landlord must offer the tenant a second opportunity using the form “Notice of Final Opportunity to Schedule a Condition Inspection”.

The landlord may make the inspections and complete the Condition Inspection Report without the tenant if the landlord has offered the tenant at least two (2) opportunities to complete an inspection, as required, and the tenant does not participate on either occasion. In this instance, the tenant would also lose the right to the return of the security or pet damage deposit at the end of the tenancy.

If the tenant is unable to attend an inspection, someone else can attend on the tenant’s behalf, but the tenant must inform the landlord and provide the name of that agent or representative before the inspection.

When there is no condition inspection or report

A landlord gives up the right to claim any of the security deposit or pet damage deposit if the tenant was not given the required opportunities to do a move-in or move-out inspection or if an inspection was completed but the landlord did not give the tenant a copy of the report within the required timelines. This requirement does not apply when the tenant abandons the rental unit.

Where a tenancy began before January 1, 2004, when an inspection report was not required or may not have been completed, the landlord and tenant should attempt to come to agreement regarding any proposed deductions.

A landlord who wants to keep some or all of a deposit must:

• get the tenant’s written consent; or
• have a DRO order from a previous dispute that the tenant has not paid; or
• obtain a DRO’s order to keep all or some of the deposit.

A caution for landlords (RTA only)

If a landlord does not comply with the rules and deadlines for returning a deposit or does not make an Application for Dispute Resolution asking to keep the deposit, a DRO may order a landlord to pay double the amount of the security deposit or pet damage deposit to the tenant and the landlord may lose the right to apply to keep the deposit.

A caution for tenants (RTA only)

A landlord can keep all of a deposit if:
• a tenant does not provide a forwarding address, in writing, within one year. (s. 39 RTA), or
• the landlord has offered at least two opportunities for the inspection and the tenant did not participate on either occasion. (s. 24 RTA).

Disputes about security deposits and pet damage deposits

When a tenant and landlord cannot come to agreement about whether the landlord can keep some or all of the deposits, either one can apply for dispute resolution asking for a monetary order. A DRO will consider evidence from both sides and decide who is entitled to the deposit monies.

The landlord must submit the Application for Dispute Resolution within 15 days after the end of the tenancy or after the tenant provides a forwarding address in writing, whichever is later. A landlord who has applied for dispute resolution can hold the deposit until the matter is resolved.

If the landlord keeps all or part of a deposit without the tenant’s written approval, and the tenant has provided a forwarding address in writing, the tenant can apply for dispute resolution asking for a monetary order. At the hearing, the tenant should provide evidence about the condition of the rental unit at the start and end of the tenancy.

谢谢,我已经在搬出前电话告诉她我的新地址了,今天我再给她一份书面的让她签名说收到我的新地址了.

现在对我们不利的是,今天已经是end of tenancy的第二天了,由于她原来答应(她第一天清洁的时候说的,说应该不用20小时)在20小时之内清洁好的,不能的话也不charge迟交房子的钱,今天她突然说要40小时,那就是要后天了,在这之前房子的condition肯定不好了,如果她当初没有答应我这个,我一早自己找cleaning service 搞定了。现在被她弄得进退两难,她发怒了又说要charge迟交房子的钱了。我让她不要再做了,我下午找cleaning lady看看到底情况怎么样。如果她立即要求inspection,那么房子肯定很多地方不行了。

1。move-out condition inspection是要双方一起做的,房客or房客的授权代理必须在场,这一点你的前物业并没有做到
2。有没有书面报告描述inspection的结果?从你的描述来看,也没有?
3。要扣部份/全部deposit,必须取得你的书面同意
4。只要你把你的新地址以书面形式通知前物业,你就马上可以make a dispute

对你来说困难的是要有各种证据证明发生过的事情,包括move-out时候公寓的condition。

dispute的过程肯定是耗时耗力的,自己权衡八,你也可以跟你的前物业说他们违反了1,2,3,你要向RTB投诉他们。

我们也拖得很后的,只是冰箱炉头浴缸事先指出的地方提前赶紧清洁了,搬完后清除垃圾加粗扫一遍就用了1小时,还是我LG一个人干的,我抱着孩子啥都帮不上忙。

我们以前公寓的管理也是这么克扣,据说每家搬走都有不同程度的损失deposit.
没时间也没有经历跟他们耗,也没找到具体条文来约束他们。估计他们也抓住了租客的这个特点。也许管理员扣多了自己有回扣。

是啊,我也算了,换了地方孩子换daycare,新房子也有很多东西要装修要买,搬的东西要收拾,工作的事也忙,实在不想为要回几百参加听证会了。刚跟他们make a deal, 地毯陪500, 给300清洁,握手了结。谢谢各位看官的意见了。

以前搬家一般只扣洗地毯的钱,那是正常的,这次最头疼。

我从公寓搬出之后就发誓再也不租了,遇人不淑啊。
