事情的来龙去脉:我因为手里有多余10000刀钱,去bmo银行去多还点mortgage.结果发现我的mortgage 多了近8千元。就是银行在没通知我的情况下把我的债务加了8000. 调查发现他们说是帮我付了condo费。去condo管理公司核实,结果被告知是我欠了换窗子的钱。欠的本钱是6千,加上欠款...
When we apply for a mortgage from the Bank, we have to sign a legal document called mortgage committment. There is a Standard Charge Term in your charge/mortgage, (you can check it). In the Standard Charge Term, you are required to keep your condo fees, realty taxes and property insurance current. If either of them is in default, they will inform your Bank. The Bank has to bring them current as they all take priority to the Bank's mortgage. The Bank has to pay it in order to avoid the Condo to register a lien on your Property, Also in the Standard charge term, you agreed to pay all the legal fees occured from it. Condo did not know your current address. According to law, they are only responsible to send letter to the address you provide to them. Frankly speaking, you should have advised Condo the change of your address.

简单点,在签 Mortgage 时, 在“Standard chargeterm” 里, 你同意银行替你交付所欠的condo fee, 然后再向你追缴, 你还同意了付一切由此产生的法律费用, 否则, 银行不会贷款给你。 其实, 一切问题的产生是由于你没有及时通知 condo 你改了地址。
Condo 只有义务给你留给他们的地址发信。

还有一个问题, 你当时贷款时, 有没有向银行保证房子是自住, 而不用来出租的, 如果有, 银行有权向你追缴全部贷款, 由此产生的所有法律费用, 也要由你全部承担。

红姐, 买个教训吧, 找什么律师都没有用的。只是白浪费钱。 我的话可能会让你失望, 可这是事实。

我以前也碰过类似的状况,比较奇怪的是你的银行的部分,我当时就是银行通知我,才发现这件事情的。

管理公司的部分你是告不了的,他可以提出所有的会议记录和每次的邮件通知当作证据,你生为共管公寓的一个成员,那是你的责任和义务去参加开会或读会议记录。

你出租房子必须主动和管理公司登记房客资料和联系...
红姐, Niyama 的这一句是很对的。

Are you sure the Bank paid your condo fees & legal fees/disbursement from your mortgage principles? or from "多余10000刀钱"?

As far as I know, they Bank will not pay other arrears from mortgage principle.

据我所知,你的出租房的land title 上得登记不同的邮寄地址,管理公司才会寄到你家通知你。否则如果你有欠钱,他们还可以lien 你的房子让你无法买卖。

我的做法是尽量不投资需要和管理公司打交道的物业,或者自己绝对记得land title 登记邮寄地址。
即使有 Lien, 也可以买卖 , 只是要先把 Lien 付清。

这个看来是真正的解释了我的疑惑。当时签mortgage的时候没有注意到。
还是那句话, 我的解释可能会让您失望, 但是....当作一个教训吧。 能用钱解决的事不是大事。
有一件事我个人认为有点蹊跷/突破的是, 你确定银行是用“mortgage principle" 付的 condo arrears & legal fees?

1.Condo 只需要证明他们把通知发出去了. It does not matter for Condo if you have received it or not.

2. Does the Bank know and allow you rent out the Condo? It yes, it is fine to go ahead; if not, the Bank can sue you further for it. It is called "breach of covenant" in law. Then my recommendition is "that is it".

很赞成这句话:能用钱解决的事情不是大事。吸取教训,用书面方式正式主动通知新的管理公司我的地址变更,及时到租客处拿到所有的信件。多谢您,看来上网也是有很多好处的,明白了很多事情,现在唯一能做的就是看看业主委员会能否根据情况(俺可一直遵纪守法)免除部分罚款。

Check to see if Bank has paid the penalty for you. If yes, then there is nothing you can do with Condo. If the Bank has not paid it, then let the Bank know immediately you will pay Condo directly and then try it with Condo.

红姐, You know what you can do......ask Condo for all the copies of letters they sent to you regarding this matter. See if the letters were sent out by registered mail, if yes, then ask them for register letters' tracking number. If they can not provide you, then it means they did not inform you properly. Based on that, you can refuse to pay all the penalty & legal costs.

但是强调一点, 你可以做以上的条件是,银行知道并允许你把房子出租。

其实银行是不希望你提前还款的,
他们是要挣利息的。

Great! now you may want to go ahead to do the followings:

1. Ask Condo for evidence that they informed you of this matter, that is, all the copies of letters they sent to you. Check if they were sent by registered mail;

2. See if Bank has paid all the penalties for you; if not, then tell them you will pay it directly to the Condo, to avoid the Bank charge you administration fee for paying that for you;

3. Ask for the breakdown of $8,000.00

okay, it is no harm to have a try... If they ask you to contact their solicitor/lawyer, ask them the contact info. and call the law firm to request copies of all the notices they sent to you, no matter what address they sent out.

Find out if you have to deal with Condo's lawyer? I double it will be the Bank's lawyer.

问题在银行支付上。但你估计没什么戏,2000块买教训吧。记住一点,房子在付清之前都是银行的,管理公司找银行要钱也不算过头。无论管理公司是否通知你,银行应当在变更之时通知你。
同意, 但是据我所知, 银行应该不会从已经收到的本金中拿出钱来去付管理公司的费用, 而是银行先替你付清 outstanding condo fees, 然后会通过银行的律师发封信给你去collect “condo fees paid by Bank & legal fees"。

看所有由银行的律师发出的信, 找日期最近的. 通常在信快结束的地方, 有联系人的电话, 打个电话,问清楚你是否已经不欠钱了。 (May be the Bank applied the $10,000 to the condo fees & legal fees) 。

If so, you are fine since they got paid. Nothing to be worried, then.

最新进展,接到condo律师回复,8000刀已经收到,我陈述理由,讲是由于他们没有用合适的方法通知我导致我没有收到信件。他们承认,但是退费没有商量,就是说利息,律师费等我就白白付了,不服可以去打官司。信件银行方面还没有消息。郁闷。
事以至此, 只能赶快联系银行, 告诉他们你会“reinburse" 银行替你付的钱。只有这样, 才会避免银行把案子交给他的律师处理, 由此产生更多费用。
