今天收到退税的信,出问题了,请大家帮助!!!
具体情况是这样的: 我2004年无收入,LG领EI共4000多,但他去年自3月份后就回国了,报税时以他Claim provinical tax,自己算应该有400多退税,但今天收到信,不但没有refund,居然要owing 300多,这合理吗? 非常感谢! |

不好意思,不懂,故不知所云。 再具体点:一家三口,移民,本人无任何收入,LG领的是parental benefit(可以回国),total income就是这点EI ,除报房租外,无任何其他需要申报项,觉得简单,就自己瞎报了,结果。。。。。今天收到的信有如下: we have disallowed your claim for a provincial tax credit since deemed resident and non-residents of canada are not eligible for this credit. since you were a resident of canada for only part of 2004,we adjusted you federal and ontario claims for personal amount to the maximum allowed.we calculated these amounts based on the number of days you were a resident in canada. 本人自己算的net federal tax 和net ontario tax都是0,但他们算的有几百,结果是balance due 300多。 不知说明没? 多谢! |

这不是说的挺清楚吗? we have disallowed your claim for a provincial tax credit since deemed resident and non-residents of canada are not eligible for this credit. 说你老公不能 maximum claim provincial tax credit. 你老公可以claim 的provincial tax credit: pronvincial tax credit for one person/ 12 * 3 |

use T1 General Income Tax and Benefit Return for Non-Residents and Deemed Residents

if you are not a resident of Ontario, you can not claim Ontario tax credit. Read the "General Income Tax and Benefit Guide for Non-Residents and Deemed Residents of Canada -2004", you will get the answer. |

Even he was living in Canada
he shall still be considered as Canadian Resident because he maintained a Canadian Tie. He had a family here, had bank account, had everything in Canada but himself. CRA ruling is wrong. They may not be able to claim Ontario Tax Credit, but, according to their income level, they shall not pay tax either. I would suggest them to get a tax expert (a certified accountant) to file an appeal. 引用:
