有谁知道discharge和charge withdraw的区别?

在pre-trail中,结果为peace bond,需要上一些课程后Get The Charge Withdrawn,不知到这是不是和dischange一样?请那位大侠告知?是给police告的.

Discharge is granted by a judge, means complete forgiveness. But, you did do something wrong. It is that the legal system will not punish you for that. It doesn't mean you are a good man.

Withdrawn is issued by a crown attorney, you no longer have to stand trial. You did nothing wrong. You are a good man. Well, sort of good man. It could be an exchange condition on which you agree to fully cooperate with legal authorities to investigate more serious crimes, or testify against other serious offenders.

专业人才啊,谢谢了,是家庭暴力,the exchange condition 就是要求参加一些课程提高认识,还以为是conditional discharge呢.

Peace bond is a legal contract (usually used for lighter spousal violence) that you agree to behave yourself for the next 12 months or so. Peace bond is not a conviction, but violate the peace bond will certainly bring you a charge.

Peace bond is not a charge, so, there won't be a discharge either. By signing a peace bond, you promise not to commit violent abuse to your spouse for a fixed time period (12 months?). In exchange, all previous charges against you will be withdrawn. This is the best outcome you can expect with family dispute case. It is a type of court order, lighter than restraining order.

I am not a lawyer. This is my understanding of terminology of justice.

我在网上查了一下,discharge是guilty但不convicted

不太一样。

国内的所谓违法和犯罪是指程度轻重，其实按照加拿大的法律，中国大部分的违法都可以归结于犯罪，比如小偷小摸在中国属于治安管理处罚范围，属于违法但不属于犯罪，但在这里也是属于犯罪。

discharge和charge withdraw和中国的所谓"无罪释放" 及"证据不足、不予起诉"更对口一些。

discharge 罪行轻微，不予指控。
charge withdraw 撤销指控。
